Terms & Conditions

The terms governing your use of Merci HRMS.

These Terms & Conditions ("Terms") govern the access to and use of the Merci HRMS platform ("Service") provided by Merciglobal Systems Pvt Ltd ("Company", "we", "us"). By registering for, accessing, or using the Service, you ("Customer", "you") agree to be bound by these Terms.

1. The Service

Merci HRMS is a human-resource, payroll, attendance and recruitment platform intended for use by businesses to manage their employees and statutory obligations. The Service is offered on a subscription basis, priced per active employee, as described on our pricing page.

2. Accounts & access

  • You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.
  • HR administrators are responsible for the accuracy of employee, salary and statutory data they enter.
  • You must notify us promptly of any unauthorised use of your account.

3. Acceptable use

You agree not to misuse the Service, including by attempting to gain unauthorised access, uploading unlawful content, or using the Service to violate any applicable law. You must have a lawful basis to store the personal and statutory data of your employees.

4. Payroll & statutory calculations

The Service computes EPF, ESI, Professional Tax, TDS, gratuity and related figures using rates and slabs configured in the platform. While we make reasonable efforts to keep these current, you remain responsible for verifying computed figures and for the timely filing and payment of all statutory dues with the relevant authorities. The Service is a tool and does not constitute legal, tax, or accounting advice.

5. Subscription & billing

  • Subscriptions are billed in advance for the applicable period based on active employee count.
  • Fees are exclusive of applicable taxes (e.g. GST), which will be added where required.
  • Failure to pay may result in suspension of access after reasonable notice.

6. Data ownership

You retain all ownership of the data you upload. We process it solely to provide the Service, in accordance with our Privacy Policy. Each customer's data is logically isolated; data from one organisation is never shared with another.

7. Availability

We strive for high availability but do not guarantee that the Service will be uninterrupted or error-free. We may perform maintenance and will make reasonable efforts to minimise disruption.

8. Limitation of liability

To the maximum extent permitted by law, the Company shall not be liable for any indirect, incidental, or consequential damages, or for statutory penalties arising from your failure to verify or file dues. Our total liability for any claim shall not exceed the fees paid by you for the Service in the three months preceding the claim.

9. Termination

You may cancel at any time as described in our Refunds & Cancellations policy. On termination, you may export your data for a reasonable period, after which it may be deleted.

10. Changes

We may update these Terms from time to time. Material changes will be notified via the Service or by email. Continued use after changes constitutes acceptance.

11. Governing law

These Terms are governed by the laws of India, with exclusive jurisdiction of the courts at Surat, Gujarat.
